Texas Law Brings Added Protection for Surviving Spouses

Effective September 1, 2025 – SB 1238


We’re happy to share some good news for Texas families. A new law—Senate Bill 1238—was passed in 2025 to help protect insurance rates for those who’ve recently lost a spouse. This change ensures that surviving spouses will continue to receive the same “married” rating on their insurance policies, just like before.


Why This Matters

In the past, when a spouse passed away, insurance companies often changed the policyholder’s marital status to “single,” which could lead to higher rates—even when nothing else changed. Now, thanks to SB 1238, that’s no longer allowed.


What’s Changing?

Starting September 1, 2025:

  • Surviving spouses will continue to be rated as “married” when renewing policies

  • This applies to auto, home, and health insurance

  • It helps keep your rates consistent during a time when stability matters most
